HIDDEN ASSETS

HIDDEN ASSETS

Hidden assets typically come into play in three situations -- Division of Property, Child Support and Maintenance or Alimony.

DIVISION OF PROPERTY.  Assets can be transferred to relatives or friends, placed in hidden accounts, overseas accounts or otherwise secreted.  My firm has the experience and resources to trace hidden assets through several means, including subpoenas, adding additional parties to the divorce, use of investigators and other means.

CHILD SUPPORT.  Hidden income is relevant to the amount of child support awarded to the non-residential parent.  Hidden income can be in the form of intentional reduction of hours and benefits, delayed benefits and bonuses, cash payments and income, in-kind payments for services, under-reporting of income for self-employed spouses, or for spouses owning or controlling a business.  Income on securities, real estate and other assets can be hidden by clever spouses.  My firm has several resources available to uncover hidden income so maximum child support is awarded.

MAINTENANCE OR ALIMONY.  Hidden income and assets are relevant to an award of maintenance (formerly known as alimony), including the amount of maintenance and the duration or length of the award.  The greater the disparity of income between the spouses the greater the chance the court will award maintenance to the lower income spouse.  Further, the amount of assets and income available to the spouses is relevant in determining the amount and duration of maintenance.  My firm has the experience to uncover hidden income and assets to provide for a maximum award of maintenance in an appropriate maintenance case.
